Has Someone You Love Been Injured By Zoloft®?
The Roberts Law Firm, P.C. Can Help

What Is Zoloft®?

Zoloft, also known by the generic name of sertraline, is a prescription medication which was approved in 1991 by the United States Food and Drug Administration (FDA). Zoloft is manufactured and marketed by Pfizer and is a widely-prescribed antidepressant medication from the selective serotonin reuptake inhibitor (SSRI) class. Zoloft is generally prescribed for the treatment of depression, obsessive-compulsive disorder (OCD), and anxiety. More specifically, pregnant women have been prescribed Zoloft to help with anxiety involved with their pregnancy.

Dangerous Side Effects Of Zoloft®

Recent studies and FDA warnings have indicated that mothers taking Zoloft or other SSRI antidepressants such as Paxil, Celexa, Lexapro, Prozac, and Symbyax during pregnancy could face a significantly increased risk of delivering a child with serious birth defects. Some of the birth defects include, but are not limited to:

  • Lung Defects
  • Heart Defects
  • Abdominal Defects
  • Neural Tube Defects of the Brain and Spine
  • Club Foot
  • Cleft Deformations of the Face

Status Of Litigation

On April 17, 2012, a panel of judges announced that it would consolidate all federal Zoloft lawsuits into a multidistrict litigation (MDL) to be overseen by U.S. District Judge Cynthia M. Rufe in the U.S. District Court for the Eastern District of Pennsylvania. The claims were brought on behalf of families of babies who were born with birth defects after their mothers took Zoloft while pregnant. The lawsuits allege that Pfizer was negligent in failing to warn the public and medical communities about the risk of congenital abnormalities associated with its best-selling antidepressant. At the time of the consolidation, over 100 Zoloft birth defect lawsuits had been filed in federal court.

When an MDL is formed, all lawsuits filed in federal court are centralized before a single judge for pre-trial proceedings. This is intended to prevent duplicate discovery and contrary decisions, and to move things as swiftly through the litigation process as possible. However, if the parties fail to reach a settlement or otherwise resolve the cases, they will be ordered back to their original jurisdictions for individual trials.
